GENERAL TERMS AND CONDITIONS OF SALE
1. SCOPE AND OBJECT OF THE GENERAL CONDITIONS
These General Conditions of Contracting and Use are intended to govern the provision of information and commercial transactions entered into between Artigos Religiosos S. José, Lda., with registered office at Rua S. José, nº 2, 2495-434 Fátima, Portugal, holding the Corporate Tax ID (NIPC) 509 417 531 (hereinafter referred to as "Loja S. José") and the User/Customer, through the website www.lojasaojose.pt.
Browsing the site, as well as purchasing any product, implies acceptance of these General Conditions. Loja S. José reserves the right to amend these conditions without prior notice, with such changes being published on the website.
2. ORDERS AND USAGE

To place an order, the User must be aged 18 years or older.

The User undertakes to provide truthful and complete data. Loja S. José assumes no liability for delays or impossibility of delivery resulting from errors in the data provided by the User (e.g., incomplete address).

The sales process is subject to compliance with the standards of Law No. 83/2017 (which repealed Law 25/2008) regarding measures to combat money laundering and terrorist financing.
3. PRODUCT INFORMATION AND PRICES

Loja S. José makes every effort to ensure that the information presented is free from typographical errors. Should a manifest error occur in the price or characteristics, the User will be contacted to confirm whether they wish to maintain the order with the correct conditions or cancel it.

The photographs presented on the website are for illustrative purposes only. The User should consult the detailed characteristics of the product.

Prices include VAT at the legal rate in force.

Loja S. José reserves the right to change prices, portfolio, and conditions at any time.
4. PRODUCT AVAILABILITY
All orders are subject to availability. If, after order confirmation, Loja S. José verifies the unavailability of any item, the Customer will be contacted within a maximum of 48 business hours. In this case, the Customer may choose to exchange it for another item or receive a full refund of the amount paid, which will be processed within a maximum of 14 days.
5. PAYMENT AND SECURITY
Loja S. José offers various secure payment methods. Loja S. José is not liable for any damages resulting from cyberattacks, viruses, or failures in the communications network that prevent access to the store or affect the User's equipment, except in cases of proven willful misconduct or gross negligence on its part.
6. LEGAL GUARANTEE
Under the terms of Decree-Law No. 84/2021, of 18 October, all goods sold at Loja S. José are covered by a guarantee of conformity of 3 (three) years from the delivery of the good. In the event of a defect or malfunction, the Customer must report the problem to Loja S. José, presenting the purchase invoice.
7. RIGHT OF WITHDRAWAL (RETURNS)
The Customer has the right to resolve the contract (return the product) without the need for justification, within 14 (fourteen) days from the day they acquire physical possession of the goods.
Conditions for Return:

The Customer must communicate their intention to return via e-mail (
geral@lojasaojose.pt) or letter, indicating the order number. -
Items must be returned in new condition, without signs of misuse, complete, with all accessories, manuals, and in the original packaging (whenever possible or if the nature of the good requires it to ensure its integrity).

Exceptions: Returns are not accepted for:

Goods made to the consumer's specifications or clearly personalized (e.g., engravings, custom-sized rings);

Sealed goods not suitable for return due to health protection or hygiene reasons when unsealed after delivery.

Refund: After receiving and verifying the condition of the goods at our facilities, Loja S. José will refund the amount paid for the products (including initial delivery costs, if applicable, except for supplementary costs resulting from your choice of a type of delivery other than the standard delivery).

The direct costs of returning the goods (postage/shipping fees to return to the store) are borne by the Customer, unless the return is due to a defect or error by Loja S. José.

The refund will be made using the same payment method used in the initial transaction, unless expressly agreed otherwise, within a maximum of 14 days.
8. LIABILITY
Loja S. José is not responsible for damages resulting from interference, interruptions, computer viruses, malfunctions, or operating system disconnections that may temporarily prevent access, navigation, or the provision of services to Users.
9. INTELLECTUAL PROPERTY
All website content (texts, images, logos) is the intellectual property of Loja S. José or third parties who have authorized its use. Total or partial reproduction without prior authorization is prohibited.
10. PERSONAL DATA PROTECTION (GDPR)
Loja S. José is committed to protecting the privacy of its Customers.

Data Collection: Personal data collected (name, address, Tax ID/NIF, e-mail, phone) is processed electronically and intended for order processing, invoicing, and, upon prior consent, sending marketing communications.

Sharing: Data will not be transmitted to third parties, except to shipping companies for the purpose of order delivery and compliance with tax obligations.

Rights: The Customer has the right to access, rectification, opposition, and deletion of their personal data. To do so, simply contact us at

11. ALTERNATIVE DISPUTE RESOLUTION AND COMPLAINTS

Complaints Book: The Customer may submit a complaint via the Electronic Complaints Book (Livro de Reclamações Eletrónico), available at www.livroreclamacoes.pt.

ADR: In the event of a consumer dispute, the consumer may resort to an Alternative Dispute Resolution (ADR) Entity. Given the location of the headquarters, we indicate:

12. APPLICABLE LAW AND JURISDICTION
All matters not expressly regulated in these Conditions shall be governed by Portuguese Law. In the event of a dispute, and failing agreement, jurisdiction is attributed to the courts of the district of Santarém (or other competent forum in accordance with civil procedural law).
